Our Terms, Conditions & Drone Policy
1. Our Commitment to You
Palm Studio Marketing is committed to providing high‑quality, consistent, and reliable real estate media marketing.
You can expect:
Prompt communication and clear booking confirmations
Professional conduct at every shoot
Attention to detail in capturing and editing content
On‑time delivery based on agreed timeframes
Straightforward file delivery via Cloud or Physical Storage devices.
A collaborative revision process through video review applications.
Respect for your time, clients, and property access
We aim to be a trusted partner and a seamless extension of your team.
2. Property Preparation
Properties are photographed and filmed exactly as they are presented upon our arrival.
It is the client’s responsibility to ensure the property is fully prepared before the scheduled shoot. This includes:
All interior and exterior lights turned on
Furniture arranged and styled as desired
Clutter removed from all visible areas
Blinds, curtains, and windows adjusted
Cars removed from driveways
Pool cleaning systems removed or tucked away
Please note: We do not move furniture, clean, or stage properties.
If the property is not ready and you do require Digital Editing or Digital/Virtual Furniture,
Please keep in mind these digital edits are billed to the Agent/Vendor, it is recommended to make sure you the Agent or Vendor are at the property before the scheduled booking for any last minute preparations, to avoid any extra costs.
3. Access & Call‑Out Fees
Clients are responsible for ensuring clear and timely access to the property.
If access is not possible (e.g. property locked, incorrect instructions), a $250 call‑out fee will apply.
4. Delivery Timeframes
Photography (before 12pm): Delivered within 1 business day
Photography (after 12pm): Delivered within 2 business days
Twilight photography: Delivered within 2 business days
Video production: Delivered within 4–6 business days
Rush delivery is available upon request (additional fees apply).
All content is delivered via Dropbox in both print and web‑ready formats.
5. File Storage & Archiving
Final edited content is stored for 60 days from the date of delivery.
After 60 days, files may be permanently deleted.
Retrieval after 60 days (if possible) will incur a $100 administrative fee.
Ongoing clients may supply their own storage drive for secure archiving for up to 13 months or until full.
6. Revisions & Feedback
One round of basic revisions is included for both photography and videography.
Photography revisions: Allow 1–2 business days.
Video revisions: May take up to 7 business days depending on complexity.
Additional revisions or those caused by client errors (e.g. incorrect spelling, late script changes) will be charged accordingly.
7. Payment Terms
Payment is due within 7 days of booking confirmation.
A 15% late fee applies to invoices unpaid after 7 days.
A payment reminder will be sent on day 7 before the late fee is applied.
8. Cancellations & Rescheduling
Cancellations within 24 hours of the scheduled shoot incur a 50% cancellation fee.
One General reschedule due to poor weather or Medical is allowed at no cost.
One general reschedule per booking is allowed; additional reschedules incur a $250 fee.
Refunds for change of mind are not granted.
If a refund is requested, depending on the situation. We may allow it or we will offer you a marketing gift card to be used for any of our services.
We reserve the right to reschedule due to adverse weather or emergencies with a minimum notice of 1 hour, where possible.
9. Copyright & Usage Rights
All media created by Palm Studio Marketing remains our copyrighted property.
Clients are granted a non‑transferable license to use the media solely for marketing the specified property.
Media may not be resold, reused for other properties, or shared with other agents/agencies without written permission.
Licensing Requirements:
Licenses must be issued in writing and paid in full before media use.
Licensing fees vary based on scope, duration, and distribution.
Unauthorised use may result in retrospective licensing fees, removal of the media, and/or legal action.
Copyright & Legal Protection:
Palm Studio Marketing retains all rights under the Copyright Act 1968 (Cth). Unauthorised use may result in immediate removal of the media, invoicing for retrospective licensing fees at commercial rates, and legal action.
10. Disclaimers
Virtual Staging & Digital Editing
These are digital enhancements and do not reflect the physical state of the property.
The client is responsible for disclosing this to potential buyers. Palm Studio Marketing accepts no liability for failure to disclose.
Floor Plans & Site Plans
Provided for marketing purposes only. Measurements/layouts are approximate and should be verified independently.
Property Condition & Accidental Damage
We accept no responsibility for accidental damage during a shoot. Properties must be safe, stable, and fragile items disclosed.
Visual Representation
All media is illustrative and promotional in nature. Slight variations in scale, depth, or views may occur.
Data Loss & Technical Failure
We take precautions but accept no liability for data loss due to technical issues. If a reshoot is possible and not client‑caused, it will be at no extra cost.
10a. Drone Operations Policy
Palm Studio Marketing operates all aerial services in compliance with CASA (Civil Aviation Safety Authority) regulations, Civil Aviation Safety Regulations Part 101, and the Excluded Category guidelines for drones under 2kg.
Weather & Safety
Flights only occur in suitable weather and visibility conditions.
We reserve the right to postpone or cancel due to unsafe conditions such as high winds, rain, fog, low light, or other hazards.
Regulatory Compliance
No flights in no‑fly zones, controlled airspace, or restricted areas without CASA authorisation.
We use CASA‑approved apps to check airspace conditions before each flight.
Licensing & Accreditation
All drones are CASA‑registered.
All operators hold RPA Operator Accreditation and are over 16 years old.
Operating Conditions
Maximum altitude: 120m (400ft).
Minimum 30m horizontal distance from people not directly involved.
Daylight and Visual Line of Sight (VLOS) conditions only.
No flights over populated areas, emergency scenes, or within restricted airspace.
Client Permissions
Clients must ensure all required permissions for flights over private property.
Lack of access or incomplete permissions may result in cancellation and a call‑out fee.
Rescheduling & Fees
If postponed due to weather, safety, or regulations, rescheduling is at no cost.
Client‑caused delays may incur a call‑out fee.
Technical Failures
We are not liable for delays or missed footage caused by technical issues beyond our control.
If a safe reshoot is possible, it will be offered at no extra cost.
Privacy & Liability
We avoid capturing private areas or individuals where reasonable privacy expectations exist.
Limitation of Liability: Liability is capped at the total amount paid for the relevant aerial service.
Indemnity: Clients indemnify Palm Studio Marketing against claims arising from misuse, lack of permissions, or breach of this policy.

11. Pricing
Service pricing is outlined in our Real Estate Media Price List and is only provided to Real Estate Agencies and Real Estate Agents.
We do require basic information from you before we release our Real Estate Media Price List.
For Example: Your Name and the Agency you work for.
Pricing is subject to change with reasonable notice.
12. Subcontracted Work
We work with qualified subcontractors who follow our same quality standards and terms and conditions outlined in a signed document.
13. Agreement & Acceptance
By proceeding with a booking, you confirm you have read, understood, and agreed to these terms.
A signed copy is not required for these terms to be enforceable.
